LPSC-Regulation Of Intrastate Waste Transportation
The transportation of waste intrastate for disposal in Louisiana is regulated by the Louisiana Public Service Commission (“LPSC”). Motor carriers must obtain a common carrier certificate or contract carrier permit before they transport waste intrastate in Louisiana. On December 20, 2017, the LPSC made a significant move to eliminate the long-standing requirement of proving “public convenience and necessity” in order to obtain a common carrier certificate or contract carrier permit for the transportation of waste. As a result of this rule change, motor carriers should now have a path to obtain statewide authority for the transportation of waste unrestricted as to number or type of vehicles, whether or not the carrier has a current LPSC certificate or permit. Change Of Ownership
Motor Carriers holding common carrier certificates or contract carrier permits are required to obtain advance approval for most ownership changes.
